2. Scope

These Terms & Conditions apply to purchases made through felixrubio.com.

By placing an order, the buyer confirms that they have read and accepted these Terms & Conditions together with the Privacy Policy, Return Policy and Shipping & Damaged Artwork Policy available on the website.

 

3. Original artworks

Unless expressly stated otherwise, all artworks offered through this website are unique, original works created by Félix Rubio Sanz.

The description of each artwork includes its title, technique, materials, dimensions, year of creation and other relevant information.

Frames, hanging systems, furniture or decorative elements shown in photographs or interior visualisations are not included unless expressly stated in the artwork description.

Minor differences may exist between the colours displayed on a screen and the physical artwork because of photography, lighting and screen settings.

 

4. Availability

All artworks are subject to availability.

As each original artwork is unique, it may become unavailable if it is sold through another authorised gallery or platform before the website inventory has been updated.

In this exceptional situation, the buyer will be informed as soon as possible and any payment received will be refunded in full.

 

5. Prices, taxes and shipping

Prices are displayed in euros.

The final amount payable, including any applicable taxes and shipping charges, will be shown before the buyer confirms the order.

Shipping costs are calculated at checkout according to the destination.

For destinations not available during checkout, the buyer should contact the artist before purchasing so that shipping availability, price and conditions can be confirmed.

For deliveries outside the European Union, customs duties, import taxes, brokerage fees or other charges imposed by the destination country are the responsibility of the buyer unless otherwise agreed in writing.

 

6. Orders and payment

The buyer must provide complete and accurate contact, billing and delivery information.

An order is confirmed once payment has been successfully processed and the buyer has received an order confirmation.

The artist reserves the right to cancel and refund an order in the event of:

  • An obvious error in the price or product information.

  • The artwork no longer being available.

  • Suspected fraudulent or unauthorised payment.

  • Delivery being impossible to the address provided.

Any cancellation made by the artist will result in a full refund of the amount paid.

 

7. Shipping and delivery

Artworks are carefully packed and shipped using a professional carrier, tracking and transport insurance, according to the conditions described in the website’s Shipping & Damaged Artwork Policy.

Estimated delivery dates are indicative and may vary because of the destination, customs procedures, carrier delays, adverse weather or circumstances beyond the artist’s reasonable control.

The buyer is responsible for providing a complete and correct delivery address and telephone number and for being available to receive the shipment.

 

8. Inspection upon delivery

The buyer should inspect the external condition of the package upon delivery.

If the packaging appears damaged, crushed, punctured, wet or opened, the buyer should photograph it before opening and retain the packaging, shipping label and internal protective materials.

Any damage to the artwork should be reported to the artist as soon as possible, together with photographs of the package, label, protective materials and artwork.

Prompt notification helps with the transport-insurance claim but does not limit the buyer’s mandatory consumer rights.

 

9. Returns and right of withdrawal

Returns and the statutory right of withdrawal are governed by the separate Return Policy available on this website.

Nothing in these Terms & Conditions limits any mandatory rights granted to consumers under applicable Spanish or European Union law.

Commissioned, made-to-order or clearly personalised artworks may be excluded from the right of withdrawal where permitted by applicable law.

 

10. Commissioned artworks

Commissioned or personalised artworks will be governed by a separate written agreement specifying:

  • The subject and creative requirements.

  • Dimensions and materials.

  • Price and payment schedule.

  • Estimated completion time.

  • Delivery conditions.

  • Review and approval process.

  • Cancellation conditions.

A commission will not be considered confirmed until the agreed deposit has been received and the written agreement has been accepted.

 

11. Ownership and intellectual property

Ownership of the physical artwork passes to the buyer after full payment has been received and the artwork has been delivered.

Purchasing an artwork does not transfer copyright or intellectual property rights.

All copyright and reproduction rights remain with Félix Rubio Sanz.

The artwork may not be reproduced, commercially exploited, tokenised, minted as an NFT, altered or used for advertising or promotional purposes without the artist’s prior written permission, except where permitted by law.

The buyer may display the physical artwork for personal and non-commercial purposes.

 

12. Certificate of authenticity

Where indicated, the artwork will be accompanied by a certificate of authenticity containing identifying information about the work and the artist’s signature.

The certificate should be retained with the artwork as evidence of authenticity and provenance.

 

13. Future resale

The buyer is responsible for complying with any legislation applicable to a future resale of the artwork, including any artist’s resale right that may apply.

The artist’s signature, certificate and identifying information must not be removed, falsified or altered.

 

14. Care of the artwork

The artist is not responsible for damage occurring after delivery as a result of:

  • Incorrect handling.

  • Unsuitable hanging systems.

  • Exposure to excessive humidity.

  • Prolonged direct sunlight.

  • Extreme temperatures.

  • Cleaning products or chemicals.

  • Accidental impact.

  • Unauthorised restoration or alteration.

The buyer should consult a qualified professional before carrying out any restoration or conservation work.

 

15. Personal data

Personal data provided during a purchase will be processed in accordance with the website’s Privacy Policy.

The information may be used for payment processing, order management, delivery, customer service, fraud prevention and compliance with legal, accounting and tax obligations.

 

16. Applicable law and disputes

These Terms & Conditions are governed by Spanish law, without prejudice to any mandatory consumer-protection rights applicable in the buyer’s country of residence.

The parties will first attempt to resolve any disagreement through direct communication in good faith.

Any unresolved dispute will be submitted to the courts or consumer dispute-resolution bodies competent under the applicable legislation.

Nothing in these Terms deprives a consumer of the right to bring proceedings before the courts legally competent for their place of residence.

 

17. Changes to these Terms

The artist may update these Terms & Conditions when necessary.

The version applicable to an order will be the version published and accepted at the time the purchase was made.
